Automobile Collision
Every year millions of people are injured in motor vehicle collisions, many very seriously. In fact, according to the National Highway Traffic Safety Administration, every 10 seconds someone in the United States is involved in an Automobile Collision. In 2005, there were an estimated 6,159,000 traffic crashes, in which 43,443 people were killed and 2,699,000 people were seriously injured.
The courts of our state look to a number of factors in determining whether a driver was negligent. Some examples of these factors include, but are not limited to, the following:
- Driving too fast
- Driving under the influence of drugs or alcohol
- Failing to signal while turning
- Disregarding weather or traffic conditions
- Disobeying traffic signs or signals
- Failing to drive on the right side of the road
Sample Case
A Cabarrus County resident traveling through Kentucky was involved in a single car collision as a passenger. As a result of the negligent actions of the vehicle’s driver, the passenger in the collision sustained multiple serious and life threatening injuries including, a broken right femur and lacerated liver. In addition to the passenger’s life threatening injuries she also received multiple lacerations and bruises, chipped teeth, and a broken right wrist. Subsequent medical treatment as a result of the collision included five surgeries and a bone graft from hip to right wrist. A lawsuit was filed in Kentucky against the negligent driver’s insurance.
Case Result
This case was settled at mediation, resulting in the insurance tendering policy limits at $250,000.00 USD.
